What do we expect from 1st of January 2023?

So far, we have had the opportunity to get acquainted with the legal provisions on electronic invoices, as well as with important dates relating to entities within the public and private sectors. According to the Ministry of finance, since the beginning of the implementation of the new law, over 180,000 users have been registered in the government portal Sistem E-faktura, of which 10,672 are from the public sector, and more than 172,106 users are from the private sector, and so far more than 4 million electronic invoices have been issued.

The Law on Electronic Invoices in the Republic of Serbia entered into force in the second quarter of 2022. As of May 1st, 2022, the public sector, as well as the private sector doing business with the public sector, first entered the system of electronic invoices. As of July 1st, all private sector members are legally obliged to receive and store invoices in public sector transactions through the state Electronic Invoice System.
What else do we expect from January 1st, 2023?

As of July 1st this year, according to the new law on electronic invoicing, private sector companies are obliged to store and receive electronic invoices through the government portal Sistem E-faktura from public sector entities, however, the beginning of 2023 brings new amendments to the law relating to the private sector.
As of January 1st, 2023, the exchange of eInvoices within the private sector will be mandatory both in mutual transactions of entities (B2B transactions), as well as in transactions with voluntary users of SEF. All these entities will have to issue, receive and keep invoices through the SEF or through one of the solutions for electronic invoices, which will ensure the recording of VAT calculations for given invoices that pass through the SEF.
